Charge added in death of trooper

January 27, 2017

Further investigation has resulted in an additional charge in the death of Colorado State Patrol Trooper Cody Donahue.

Noe Gamez-ruiz, 41, of Denver, has been charged with criminally negligent homicide, a Class 5 felony.

The charge carries a presumptive sentencing range of 1-3 years in the Department of Corrections.

On Nov. 25, 2016, Donahue was fatally struck by a vehicle on I-25 near Tomah Road while conducting a traffic accident investigation.

Gamez-ruiz was charged previously with careless driving resulting in death and failure to yield right-of-way to an emergency vehicle. Those charges remain.

Criminal charges are merely a formal accusation that an individual has committed a crime. A defendant is presumed innocent unless proven guilty.
